These Terms of Service (“Terms”) are an agreement between you and Underground Games LLC (“Underground Games,” “we,” “us”). They govern your use of https://undergroundgames.xyz and our games and services (together, the “Services”). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

Who can use the Services

You must be at least 13 years old (or the minimum age required in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or guardian. The Services are not directed to children under 13.

Your account

Some features require an account. You're responsible for keeping your login secure and for activity under your account. Let us know promptly at info@undergroundgames.xyz if you suspect unauthorized use.

Purchases, memberships, and refunds

Some Services offer paid content or memberships. Purchases made directly with us are processed by our payment provider; purchases through the Apple App Store or Google Play are processed and governed by those platforms, including their refund and subscription rules. Where a subscription renews automatically, you can manage or cancel it through your account or platform settings; cancellation takes effect at the end of the current billing period unless the law provides otherwise. Prices and offerings may change, and we may add, remove, or modify content and features over time.

Acceptable use

You agree not to:

• break the law or infringe others' rights while using the Services;
• cheat, exploit, tamper with, reverse engineer, or disrupt the Services or other players' experience;
• access the Services through unauthorized means, bots, or scrapers, or attempt to bypass security or usage limits;
• upload content you don't have the right to share, or anything unlawful, harmful, or abusive;
• misuse real-time or multiplayer features to harass or harm others.

User content

Some Services let you add content — for example, your own photos to turn into a puzzle. You keep ownership of what you add. You grant us a limited, worldwide, royalty-free license to host, store, and display that content solely to operate and provide the Services to you. You're responsible for ensuring you have the rights to any content you upload.

Our intellectual property

The Services, including our games, software, branding, and the names “Underground Games,” “Unfolded Globe,” and “Mahjong Underground,” are owned by Underground Games LLC or our licensors and are protected by law. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. All rights not expressly granted are reserved.

Third-party services

The Services rely on and may link to third parties (for example, app stores, payment, analytics, advertising, and hosting providers). We're not responsible for third-party services, and your use of them is governed by their terms.

Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don't warrant that the Services will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Underground Games LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim or USD $100.

Indemnification

You agree to indemnify and hold harmless Underground Games LLC from claims and expenses arising out of your misuse of the Services or violation of these Terms, to the extent permitted by law.

Termination

You can stop using the Services at any time. We may suspend or end your access if you violate these Terms or to protect the Services or other users. Sections that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, and by applicable United States federal law. Any disputes will be handled in the appropriate courts located there, unless the law where you live gives you the right to bring proceedings elsewhere.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the “Last updated” date above, and continued use of the Services after changes take effect means you accept the updated Terms.
